House rules

NEMA uses a number of social media networks to complement its traditional public information dissemination activities. These include Facebook, Instagram, LinkedIn, and YouTube (collectively known as NEMA Socials). 

NEMA Socials are the voice of NEMA, aiming to inform, engage with and educate audiences by demonstrating the operations, functions and successes of NEMA staff and operations. Using a mixture of standalone, interactive, visual and audio content, NEMA Socials develop and deliver current content and new developments relevant to the NEMA work environment in a timely manner.

NEMA Socials aim to assist in information dissemination in an understandable and relatable manner. Unless otherwise indicated NEMA Socials don’t aim to provide an advisory service – any information provided on the NEMA website or in NEMA Socials should be considered in the light of your personal circumstances and if need be you should seek you own advice germane to your personal circumstances. In particular, the NEMA website and NEMA Socials don’t provide legal or financial advice.

The number and nature of NEMA Socials will change over time. The following disclaimer applies to all NEMA Socials, regardless of whether they are listed on the NEMA website or linked to the NEMA website at www.nema.gov.au.

NEMA Socials may occasionally be unavailable and NEMA accepts no responsibility for a lack of response due to network downtime or outages. NEMA reserves the right to close any or develop any NEMA Socials for any reason, at any time, without advance notice.

NEMA personnel must read and comply with any policies in place including but not limited to any media and communication policies and any other relevant social media policies and/or standing orders, before:

  1. posting or commenting on any social media site or
  2. purporting to issue any media release or public statement by or on behalf of NEMA. 

By accessing NEMA Socials you indicate your acceptance of these ‘Terms of Use’. NEMA may amend these Terms of Use at any time, and may do so with immediate effect. If you continue to access NEMA Socials you should to check this page on a regular basis in order to be aware of, acknowledge and comply with any changes that we make.

Comments posted by individuals accessing NEMA Socials are not endorsed, supported, sanctioned, encouraged or verified by NEMA. NEMA does not purport to agree with any comments, opinions or statements posted by users/members on NEMA Socials including those by NEMA staff or contractors. Any information or material placed online by users, including advice and opinions, is the view and responsibility of those users and does not necessarily represent the views of NEMA. We make no representation as to the accuracy of any user content, nor do we take responsibility for any user content or the content of any third-party websites linked to by any user content.

NEMA endeavours to keep all NEMA Socials up to date, however, NEMA’s website www.nema.gov.au should be regarded as the source of up-to-date information, and where there is any inconsistency or ambiguity, NEMA’s website will prevail.

Journalists seeking an official NEMA view on any issue should contact NEMA directly.

NEMA staff, stakeholders and partners should be aware that any information posted on NEMA Socials is publicly viewable and searchable. What you post online may remain there indefinitely and can be found through search engines and online archives and may remain available for posterity.

By posting your content to NEMA Socials, you acknowledge and agree that: 

  1. When you publish your content on NEMA Socials, you are allowing everyone, including other users, to access and use that information and to associate it with you
  2. You own and/or have obtained all necessary rights to use and publish your content on NEMA Socials
  3. You create and provide your content on NEMA Socials at your own risk and you are responsible for your content 
  4. You are not entitled to any payment from NEMA in respect of your content or as a result of NEMA’s use of your content, and
  5. Your name and your content may be collected, stored and used by NEMA to respond to your feedback, communicate with you, and to help us research the needs of our users in order to improve our services. We may share this information with our related organisations and to third parties who provide services to us.

Comments 

While NEMA never wishes to stifle conversation or even active debate on NEMA Social, users must not post or upload any comments or links to other social media presences that are unlawful, or may defame, discriminate, offend, interfere with privacy or infringe copyright or other intellectual property rights. NEMA reserves the right to moderate comments and may remove any comments that, in NEMA’s opinion, are inappropriate or illegal, and may, during periods of reduced staffing or high demand, turn-off or limit commentary on NEMA Social.

Respect

When using NEMA Social you are welcome to express your views, comments, ideas, insights and criticisms about NEMA. At the same time, you must show courtesy and respect to others and must not use NEMA Social to abuse others or expose others to offensive or inappropriate content.

Prohibitions

Your comments/replies/uploaded content must not engage in: 

  1. Defamation,
  2. Abuse,
  3. Bullying,
  4. Intimidation,
  5. Discrimination or vilification of a person or section of the community on account of race, ethnicity, nationality, gender, age, sexual preference, religion, disability, mental illness or political belief,
  6. Harassment, or
  7. The violation of the legal rights of any individual or entity.

Your comments/replies/uploaded content must not:

  1. Contain nudity, offensive, obscene or inappropriate language or material, hate speech, violence, threats, sexist or racist material or any other material that is considered indecent or degrading to any person or section of the community;
  2. Constitute 'trolling' that is deliberately disruptive or provocative,
  3. Contain content that is illegal or infringes any third-party intellectual property rights (such as copyright),
  4. Contain personal information about you or someone else,
  5. Be fraudulent, incorrect, misleading or deceptive, or
  6. Personally, and negatively identifies a NEMA staff member.

Post moderation

Comments and messages on NEMA Social are ‘post-moderated’. This means that comments will be published automatically and reviewed by NEMA after publication. Comments that violate the terms of use will be removed or not published. We will not edit comments. 

NEMA does not undertake to inform users when their comments and posts are moderated, however, we will warn and take appropriate action to suspend and expel users who regularly and consistently submit inappropriate content. Repeat offenders may be blocked from operating within NEMA’s social media presences indefinitely.

Links

Links to external websites and other third-party social media presences from NEMA Social are provided merely as a convenience to users. The inclusion of any link (or retweet/share) does not expressly indicate or imply endorsement of that website, content, links, social media presence, service or individual by NEMA. 

NEMA is not responsible for the content or reliability of third-party links, or for any loss or inconvenience arising from their use. While NEMA tries to moderate content posted on its social media networks, NEMA is not legally responsible for any material posted by third parties. You acknowledge that access to any links to third-party websites are provided for convenience only, and you are responsible for evaluating whether you want to use them, or whether they are correct or fir for purpose.

Social Sharing

NEMA may share posts from one element of NEMA Social to another element of NEMA social. Please note that this does not imply endorsement of the content and the content provider by NEMA in any way. 

Please do not participate in NEMA Social if you do not agree with these Terms of Use.

Campaigns

NEMA may run social media campaigns from time to time, for example in relation to disaster recovery or compensation schemes. These campaigns may have standalone terms and conditions published from time to time. If applicable, familiarise yourself with the respective campaign’s terms and conditions should you wish to participate.

Imagery

All image and video materials published on NEAM Social (our content) are property of NEMA and are protected by intellectual property laws. See our website for more details.
